Bard, the manufacturer of implantable port catheters (small devices placed under the skin to deliver medications). A federal court has ruled that the case can move forward, including punitive claims that Bard knew their devices were dangerous but continued selling them anyway. You had a Bard-brand port catheter surgically implanted in 2013 or later

You suffered one of these complications while the device was implanted:

  • A broken or fractured catheter (with or without the piece traveling in your body)
  • A serious bloodstream infection or sepsis (at least 2 weeks after implant)
  • A blood clot, stroke, or pulmonary embolism
  • A skin or tissue infection around the port site, including tissue death
  • Your device had to be surgically removed as a result.

You likely do not qualify if your only issue was device flipping or pain without surgical removal.
